These Terms of Service constitute a legally binding agreement between you and Pune Culture. Please read them carefully before using the Platform. By accessing or using Pune Culture, you agree to be bound by these Terms in their entirety.
By accessing, browsing, registering on, or otherwise using the Pune Culture platform (accessible at puneculture.com and its subdomains, mobile applications, APIs, and related services, collectively the "Platform"), you ("User," "you," or "your") acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Content Policy, and Community Guidelines, all of which are incorporated by reference herein.
If you do not agree to these Terms in full, you must immediately cease all access to and use of the Platform. Your continued use of the Platform after any modification to these Terms constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of India, including the Information Technology Act, 2000; the Consumer Protection Act, 2019; the Indian Contract Act, 1872; and all applicable rules and regulations thereunder. In case of conflict between any translated or summarized version and the English original, the English version shall prevail.
2.1 Age Requirement
You must be at least 18 years of age to create an account or use any features of the Platform. By registering, you represent and warrant that you are 18 years of age or older and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
2.2 Account Registration
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials. You must promptly notify us of any unauthorized use of your account.
2.3 Single Account Policy
Each user is permitted to maintain only one active account. Creating multiple accounts to circumvent bans, manipulate reviews, or abuse platform features is strictly prohibited and may result in permanent termination of all associated accounts.
2.4 Account Security
You are solely responsible for all activities conducted under your account. Pune Culture will not be liable for any loss arising from your failure to secure your login credentials. We will never ask for your password via email, social media, or phone.

As a user of Pune Culture, you agree to use the Platform lawfully, ethically, and in accordance with all applicable Indian laws. You specifically agree to:
5.1 Our Intellectual Property
All original content, editorial articles, guides, photographs, illustrations, logos, design systems, UI components, typography selections, data compilations, source code, databases, and trademarks published on the Platform are the exclusive intellectual property of Pune Culture or its licensors and are protected under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international intellectual property laws.

Without our explicit prior written consent, you may not:

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes only. This license does not include any right to resell, sublicense, or create derivative works from Platform content.
You retain full ownership of all content you create and submit to the Platform ("User Content"), including reviews, ratings, comments, posts, photographs, and videos. By submitting User Content, you grant Pune Culture a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:
This license terminates when you delete your User Content from the Platform, except where the content has been shared by other users or incorporated into archives. You represent and warrant that: (a) you own or have the rights to submit the User Content; (b) the User Content does not infringe any third-party rights; and (c) the User Content complies with all applicable laws.
Moral Rights: To the extent permitted by Indian law, you waive any moral rights in your User Content that may otherwise restrict Pune Culture's exercise of the license granted above.
Property owners, business operators, and partners ("Partners") who list their services on Pune Culture agree to the following additional obligations:
7.1 Accuracy of Listing Information
Partners represent and warrant that all listing information — including but not limited to property name, address, contact details, photographs, pricing, availability, amenities, safety standards, legal approvals, and occupancy compliance — is accurate, current, and complete. Partners agree to update their listings within 7 business days of any material change.
7.2 Legal Compliance
Partners are solely responsible for ensuring their business operations comply with all applicable local, state, and national laws, including property laws, FSSAI regulations (for food establishments), fire safety codes, rental registration requirements, and GST compliance. Pune Culture is not responsible for a Partner's legal non-compliance.
7.3 Prohibited Practices
Partners may not solicit, incentivize, or coerce users to submit positive reviews or ratings for their listings. Any attempt to manipulate the review system — including submitting fake reviews from employee accounts, offering discounts in exchange for reviews, or threatening users who post negative reviews — will result in immediate listing removal and may lead to legal action.
7.4 Pune Culture's Role
Pune Culture provides a listing directory and promotional platform only. We do not act as an agent, broker, landlord, or franchisor for any listed establishment. We do not guarantee bookings, occupancy, revenue, or visitor traffic resulting from a listing on our Platform.
The following activities are strictly prohibited on the Platform. Violation may result in immediate account termination and civil or criminal legal action:
9.1 "As Is" Disclaimer
THE PLATFORM AND ALL CONTENT, LISTINGS, AND SERVICES PROVIDED THEREON ARE MADE AVAILABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.
9.2 Third-Party Content
Pune Culture does not verify, endorse, or guarantee the accuracy of user-submitted reviews, partner listing information, business hours, pricing, or availability. We are not responsible for any inaccuracies in third-party listings or the experiences users have at listed establishments.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, PUNE CULTURE AND ITS FOUNDERS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY:
In any case, Pune Culture's aggregate liability for any claim arising under these Terms shall not exceed the amount paid by you (if any) to Pune Culture in the three (3) months preceding the event giving rise to the claim, or ₹500 (Five Hundred Rupees), whichever is greater.
9.4 Trek & Outdoor Activity Disclaimer
Trekking guides, outdoor activity recommendations, and adventure route information on the Platform are for general informational purposes only. Outdoor activities involve inherent and significant physical risks including injury and death. Pune Culture accepts no liability whatsoever for accidents, injuries, losses, or fatalities resulting from activities described on the Platform. Always verify route conditions with local authorities before undertaking any outdoor excursion.
You agree to defend, indemnify, and hold harmless Pune Culture, its founder(s), employees, contractors, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
We reserve the right to assume exclusive control and defense of any matter subject to indemnification by you, at your cost and expense. You agree to cooperate fully with our defense of such claims.
11.1 Termination by Pune Culture
We reserve the right to suspend, restrict, or permanently terminate your account and access to the Platform, with or without prior notice, if we reasonably determine that you have: (a) violated these Terms; (b) engaged in fraudulent, abusive, or illegal conduct; (c) posed a risk to other users or the Platform's integrity; or (d) failed to pay applicable partner fees. In cases of serious violations, we may report your conduct to law enforcement authorities.
11.2 Termination by User
You may delete your account at any time through your account settings or by contacting us. Upon deletion, your profile data will be removed within 30 days. However, User Content that has been publicly published and shared by other users may remain on the Platform in anonymized form unless you specifically request individual content deletion.
11.3 Effect of Termination
Upon termination, all licenses granted to you cease immediately. Sections relating to intellectual property, indemnification, limitation of liability, and governing law shall survive termination of these Terms indefinitely.
11.4 Appeals
If your account is suspended and you believe the action was taken in error, you may appeal by emailing [email protected] with subject line "Account Suspension Appeal" within 14 days of the suspension notice. We will review and respond within 7 business days.
12.1 Informal Resolution
Before initiating formal legal proceedings, both parties agree to attempt resolution of any dispute informally by contacting [email protected]. We will make reasonable efforts to resolve disputes within 30 days of notice.
12.2 Consumer Dispute Resolution
For consumer disputes governed by the Consumer Protection Act, 2019, you may also approach the appropriate Consumer Disputes Redressal Commission (District, State, or National level) as per the pecuniary jurisdiction defined under the Act.
12.3 Arbitration
Any dispute arising out of or in connection with these Terms that cannot be resolved informally shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be within Maharashtra, India. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon by the parties. The arbitral award shall be final and binding.
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law provisions. For any matters not subject to arbitration, you irrevocably submit to the exclusive jurisdiction of the competent courts located in Maharashtra, India.
If you are accessing the Platform from outside India, you are responsible for compliance with all applicable local laws. We make no representation that the Platform is appropriate or legally available in jurisdictions outside India.
We reserve the right to amend these Terms at any time. For material changes, we will provide at least 14 days' notice by posting the updated Terms on the Platform and, where applicable, sending notice to your registered email address. The updated "Last Updated" date will reflect the effective date of all changes.
Your continued use of the Platform after the effective date constitutes your binding acceptance of the revised Terms. If you disagree with any modification, you must immediately cease use of the Platform and may delete your account. Minor clarifications, grammar corrections, and non-material formatting updates may be made without prior notice.

Legal notices must be sent in writing via email with a valid name and contact information. Notices submitted anonymously will not be processed. We will acknowledge receipt within 48 business hours.
Severability: If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, Content Policy, and Community Guidelines, constitute the entire agreement between you and Pune Culture regarding your use of the Platform and supersede all prior agreements and understandings.
No Waiver: Failure by Pune Culture to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
